The terms governing the use of our website and the supply of pharmacy products and services by SPHN&M Limited.

These Terms and Conditions apply to all users of the SPHN&M Limited website (sphnm.co.uk) and to all customers who purchase products or services from us, whether in person at our pharmacy at 12 Seddon Road, Wigston, England, LE18 3UL, or remotely. Please read these terms carefully before using our services.
1. Definitions
In these Terms and Conditions:
- “We”, “us”, “our” means SPHN&M Limited, a company registered in England and Wales with company number 07920056, whose registered office is at 12 Seddon Road, Wigston, England, LE18 3UL.
- “You”, “your” means the person using our website or purchasing our products or services.
- “Products” means medicines, medical devices and other items supplied by us.
- “Services” means pharmacy services provided by us, including but not limited to NHS and private prescription dispensing, health checks, vaccinations and consultations.
2. Scope of Services
We are a General Pharmaceutical Council (GPhC) registered pharmacy operating under an NHS Community Pharmacy Contract. We supply prescription-only medicines (POMs) only against a valid prescription issued by an appropriate prescriber. We also supply pharmacy (P) medicines and general sales list (GSL) products.
All services are subject to availability, clinical appropriateness and our professional judgement. We reserve the right to refuse to supply any product or service if we believe it is not clinically appropriate, safe or lawful to do so.
3. Ordering and Payment Terms
Prescriptions: NHS prescriptions are dispensed in accordance with NHS England regulations and are subject to NHS prescription charges where applicable (unless you are exempt). You must present a valid exemption certificate or pay the statutory charge at the time of collection or delivery.
Private prescriptions and over-the-counter products: Payment is required at the time of order or collection, unless you have an approved credit account with us for care home or trade supply.
Care home and trade orders: Invoices are payable within 30 days of the invoice date unless otherwise agreed in writing.
We accept payment by cash, debit card and credit card. All prices are quoted in pounds sterling (£GBP) and include VAT where applicable.
4. Delivery and Supply Terms
We offer a free prescription delivery service to housebound patients within the local Wigston and LE18 area, subject to our discretion and capacity. Delivery times are estimates and may vary due to unforeseen circumstances.
For care home and wholesale orders, delivery dates are agreed at the time of ordering. Risk in the products passes to you upon delivery. We are not liable for delays caused by events outside our reasonable control.
5. Cancellation and Refunds
Prescription medicines: Once a prescription-only medicine has been dispensed specifically for you, it cannot be returned or refunded except in the very limited circumstances permitted by law (for example, if the product is defective or incorrectly supplied).
Over-the-counter products: Unopened, unused over-the-counter products may be returned within 14 days of purchase with proof of purchase, in accordance with the Consumer Rights Act 2015. Products that are opened, used or past their expiry date cannot be refunded.
Services: If you book a private vaccination or consultation and need to cancel, please give us at least 24 hours’ notice. Cancellations with less than 24 hours’ notice may be charged at our discretion.
6. Limitation of Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Subject to the above, our total liability to you for any claim arising out of or in connection with the supply of products or services shall be limited to the price paid for the product or service in question. We shall not be liable for any indirect, consequential or special losses.
7. Intellectual Property
All content on this website, including text, images, logos and design, is the property of SPHN&M Limited or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or commercially exploit any material from this website without our prior written consent.
8. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events outside our reasonable control, including but not limited to acts of God, severe weather, pandemic, war, terrorism, strikes, lock-outs, accidents, fire, flood, or failure of third-party suppliers or transport.
9. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
10. Dispute Resolution
If you have a complaint about our products or services, please contact us in the first instance at info@sphnm.co.uk or in writing to our registered office. We will aim to resolve your complaint promptly and fairly.
If you are a consumer and we are unable to resolve your complaint, you may have the right to refer the dispute to an alternative dispute resolution body. However, we are not currently obliged to use an alternative dispute resolution provider.
11. Amendments
We may update these Terms and Conditions from time to time. The latest version will always be available on this page. Continued use of our website or services following any changes constitutes acceptance of the revised terms.
